These Terms & Conditions (“Terms”) govern your use of the CineSprout mobile application for iOS and Android (the “Application”), operated by RefineSpark Studio (“we”, “us”, “our”). By downloading, installing, or using the Application, you agree to these Terms. If you do not agree, do not use the Application.
These Terms are a legal agreement between you and RefineSpark Studio. They apply together with our Privacy Policy, which explains how we handle information. If you use the Application on behalf of an organisation, you represent that you have authority to bind it.
You must be at least 16 years old, or the age of digital consent in your jurisdiction if higher, to use the Application. If you are below that age, a parent or legal guardian must review and accept these Terms for you. By using the Application, you represent that you meet these requirements.
CineSprout is a catalogue and discovery app for films and television. It displays metadata, artwork, ratings, and related information supplied by TMDB (The Movie Database). It does not host, stream, sell, or provide access to films or television programmes.
CineSprout is not affiliated with, endorsed by, or sponsored by TMDB, any film studio, streaming service, or rights holder. All titles, artwork, and trademarks belong to their respective owners.
TMDB is operated by TiVo Platform Technologies LLC. Your use of TMDB data and services is also subject to TMDB’s API terms of use.
CineSprout creates an anonymous identity for each installation. It does not ask for your name, email address, phone number, or a password.
You are responsible for maintaining the security of your device and for any activity that occurs through your installation.
Some features require a TMDB account. If you choose to connect one:
TMDB may change, limit, or discontinue its API or your access to it. We are not responsible for TMDB’s services, content, availability, or decisions.
The Application also relies on Supabase, Expo/EAS, and the Apple App Store or Google Play. Their terms and privacy policies apply to their services.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Application on a device you own or control, for personal, non-commercial use.
You may not:
We own the Application’s code, design, interface, trademarks, and branding, and we reserve all rights not expressly granted to you.
TMDB and its licensors own the film and television metadata, ratings, and artwork displayed in the Application. You may not extract, redistribute, or use that content except as permitted by TMDB’s terms and applicable law.
This application uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB. See TMDB’s attribution guidelines.

We may suspend or terminate access if you breach these Terms. Where a breach can be cured, we will give you written notice and 14 days to remedy it. We may act immediately without notice if you violate the law, infringe intellectual property rights, or engage in activity that could harm other users, us, or our service providers.
CineSprout does not let you post, upload, publish, or share content with other users. Your watchlist, favourites, and ratings are stored on your own TMDB account and are governed by TMDB’s terms. Because we do not host user content, CineSprout is not a hosting service or intermediary for user-generated content, and these Terms do not grant us a licence to content you have not submitted to us.
The Application requires an internet connection and depends on TMDB and other third-party services. We do not guarantee that it will always be available, uninterrupted, or error-free.
We may update, modify, or discontinue the Application or any feature at any time. We may also stop supporting older versions or operating systems. You should install updates when offered; if you do not, the Application may not work properly. Where required by law, we will give reasonable notice of material changes that adversely affect you.
CineSprout is currently provided free of charge. We may introduce paid features or charge for the Service in the future. We will clearly disclose any price and obtain your consent before charging you. Nothing in these Terms obliges you to pay for a feature you have not agreed to purchase.
You are responsible for your device, its security, and its battery. If you use the Application on a mobile network, your network provider’s terms apply, and you may incur data charges, including roaming charges. You accept responsibility for those charges. If you are not the bill payer for the device, you represent that you have the bill payer’s permission.
We strongly advise against jailbreaking or rooting your device. Doing so can compromise your security and may cause the Application to malfunction.
To the fullest extent permitted by law, the Application is provided “as is” and “as available”. We disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that:
Nothing in these Terms limits any rights you have under mandatory consumer protection law.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising out of or relating to your use of the Application, even if we were advised of the possibility.
Our total liability for any claim relating to the Application is limited to the greater of (a) the amount you paid us for the Application in the 12 months before the claim, or (b) the minimum amount required by applicable law. Because the Application is currently free, this means our liability is limited to the minimum amount permitted by law.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited by law.
To the fullest extent permitted by law, you agree to indemnify and hold harmless RefineSpark Studio, its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your intentional misuse of the Application.
This does not apply to claims caused by our own negligence, our breach of these Terms, or our violation of applicable law. Where consumer indemnification is restricted by law, this clause is limited to the maximum extent permitted.
These Terms remain in effect while you use the Application. You may stop using it at any time and delete your identity in Profile → Delete account.
We may suspend or terminate your access as described in section 8. On termination:
Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
If you downloaded the Application from the Apple App Store:
If you downloaded the Application from Google Play, you must comply with Google Play’s terms of service. Google is not a party to these Terms and has no responsibility for the Application.
These Terms are governed by the laws of the jurisdiction in which RefineSpark Studio is established, excluding conflict-of-law rules, except where mandatory consumer protection laws provide otherwise.
Any dispute arising out of or relating to these Terms will be brought before the courts with jurisdiction under applicable law. Nothing in this clause limits any right you may have to bring a claim in a court that is competent under mandatory law.
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions will remain in full force.
These Terms, together with the Privacy Policy, are the entire agreement between you and RefineSpark Studio concerning the Application and supersede any prior agreements or understandings on that subject.
We may update these Terms from time to time. We will post the updated version with an effective date and, where required by law, notify you in the app or by other appropriate means. If you continue to use the Application after the effective date, you accept the updated Terms. If you do not agree, you must stop using the Application. Previous versions are available on request.
